1. Acceptance of Terms

By downloading, installing, or using Trail Map GPS (the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Regal Masters / Palo Tata Services ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by email. Continued use of the App after modifications constitutes acceptance of the updated Terms.

2. Description of Service

Trail Map GPS is a mobile application providing GPS navigation, trail mapping, offline map downloads, weather and elevation data, trail recording, waypoint management, and related features designed for hiking and biking activities. The App is available for Android and iOS devices, as well as through a progressive web app (PWA).

Features, availability, and functionality may vary by subscription tier and are subject to change. We strive to maintain and improve the Service but do not guarantee uninterrupted or error-free operation.

3. Subscription Plans and Billing

All subscriptions are billed exclusively through the Google Play Store (Android) or Apple App Store (iOS). We do not accept payments through our website, PayPal, or any other payment method. Subscription management, including upgrades, downgrades, and cancellations, must be performed through the respective app store.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Renewal charges are processed by the respective app store at the then-current subscription rate.

3.3 Refunds

Refund requests are handled by the respective app store in accordance with their refund policies. Please contact Google Play Support or Apple Support directly for refund requests. We do not process refunds directly.

4. User Responsibilities

By using Trail Map GPS, you agree to:

Safety First: Trail Map GPS is a navigation aid, not a replacement for proper outdoor safety preparation. Always carry backup navigation tools (physical map and compass), inform others of your planned route, check local conditions before departing, and follow all local laws and regulations.

Responsible Use: Stay on marked and authorized trails. Respect private property, wildlife, and other trail users. Follow Leave No Trace principles. Do not trespass on restricted areas regardless of what map data may indicate.

Account Security: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

Accurate Information: You agree to provide accurate and complete information when creating your account and to keep your information up to date.

Lawful Use: You will use the App only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.

6. Intellectual Property

All content, features, functionality, design elements, trademarks, logos, and software code of Trail Map GPS are owned by or licensed to Regal Masters / Palo Tata Services and are protected by United States and international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of the App or any part thereof.

6.1 User-Generated Content

You retain ownership of content you create within the App (trail recordings, waypoints, journal entries, photos). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process this content as necessary to provide and improve the Service.

7. Account Termination

You may delete your account at any time by contacting support@trailmapgps.com. Account deletion will result in the permanent removal of your data within 30 days.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, abuse the Service, or if required by law. In such cases, we may terminate your access without refund for the remaining subscription period.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAIL MAP GPS AND Regal Masters / Palo Tata Services SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(a) Your use of or inability to use the Service; (b) Any errors, inaccuracies, or omissions in GPS positioning, map data, trail information, weather data, or elevation data; (c) Personal injury or property damage resulting from your use of the Service; (d) Unauthorized access to or alteration of your data; (e) Failure of emergency features to deliver messages or alerts; (f) Any interruption or cessation of the Service.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless Regal Masters / Palo Tata Services, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any injury or damage arising from outdoor activities undertaken while using the App.

10. Dispute Resolution

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the State of California. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action, class arbitration, or representative action.

Exception: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. To the extent litigation is permitted under these Terms, it shall be conducted in the state or federal courts located in California.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Regal Masters / Palo Tata Services regarding the use of Trail Map GPS. Any prior agreements, communications, or understandings regarding the Service are superseded by these Terms.

These Terms of Service are effective as of March 12, 2026 and apply to all users of the Trail Map GPS application and website. These terms comply with Google Play Store and Apple App Store requirements.
